Overview
These Terms of Service ("Terms") govern your access to and use of Viddz, a video messaging service that lets you record, share, and attach call-to-action buttons to videos. By creating an account or using the Service, you agree to these Terms.
1. Your account
You need an account to record and manage videos on Viddz. You're responsible for keeping your credentials secure and for everything that happens under your account. If you suspect unauthorized access, email us immediately.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
2. Your content
You retain all rights to the videos, audio, and other content you record and upload ("Your Content"). We don't claim ownership of Your Content.
To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, process, stream, and display Your Content solely for the purpose of providing the Service to you and the viewers you share with. This license ends when you delete the content or your account.
3. Acceptable use
You agree not to use Viddz to:
- Record or share content you don't have the right to record or share, or that violates someone else's privacy.
- Upload or link to unlawful, infringing, fraudulent, or harmful material.
- Harass, threaten, or impersonate anyone, or collect personal information without consent.
- Send spam, attempt to phish viewers, or direct CTAs to malicious destinations.
- Attempt to disrupt the Service, bypass rate limits, or access data you don't own.
- Reverse-engineer, scrape, or resell the Service without our written permission.
We may remove content or suspend accounts that violate these rules, with or without notice depending on severity.
4. Call-to-action buttons
The CTA feature lets you link viewers to any URL of your choice. You are responsible for where those links lead. Destinations that distribute malware, phish, or violate applicable law are not permitted and may result in immediate takedown.
5. Third-party services
Viddz is built on top of third-party services including Google Firebase and Mux. Your use of the Service is also subject to the relevant terms of those providers where applicable. We do not control and are not responsible for the availability or behavior of third-party services you link to through CTAs.
6. Fees and plans
Some parts of Viddz may be offered at no cost; others may require a paid plan. If paid plans apply to you, pricing, billing, and cancellation terms will be disclosed at the point of purchase and become part of these Terms.
7. Termination
You can stop using Viddz and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if we're required to by law, or if continued operation would pose a security risk.
On termination, your videos, CTAs, and associated data will be deleted in the ordinary course of our retention schedule.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or perfectly secure.
9. Limitation of liability
To the fullest extent permitted by law, Viddz will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim (or, if you're on a free plan, USD $100).
10. Indemnification
You agree to indemnify and hold Viddz harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
11. Changes to these terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above and notify active users of material changes by email. Continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Viddz is incorporated, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts of that jurisdiction unless otherwise required by mandatory local law.
